Types of Majorities :
1) Absolute Majority
2) Simple Majority
3) Effective Majority
4) Special Majority
1) Absolute Majority : More than 50 % of the total strength of the house. For Eg : Loksabha has 545 members , so Absolute Majority would be 273 ( more than 50 % ) .
It is used in general election for formation of government at centre and state legislatures.
2) Simple Majority : More than 50 % of present and voting . For eg there are 545 members in loksabha , only 300 members have attended the parliament . Only 250 members would like to vote. Remaining 50 members don't want to vote. If a bill has to pass in Simple Majority , it must have 126 votes that is more than 50 % of members present and voting.
It can be used in :
1) To pass money bill/financial bill/ordinary bill
2) To declare financial emergency and Presidential Rule
3) To elect speaker and deputy speaker of the loksabha
4) To pass No confidence motion, censure motion, Adjournment motion
5) Constitution Amendment Acts under art 368 need ratification of the states need simple majority of the legislature.
3) Effective Majority : More than 50% of the effective strength of the house. Effective strength is calculated as subtraction of vacant seats from total strength of the house. For eg : Loksabha has total strength of 545 members , if there are 15 vacant seats then effective strength is 545- 15= 530.
If a bill has to pass under effective majority then it must has 266 votes.
It is used in :
1) Removal of Chairman and Deputy chairman of Rajyasabha
2) Removal of Speaker and Deputy speaker of loksabha and state legislature.
4) Special Majority : There are four types of special majorities.
1) According to article 249 , Special majority refers to more than 2/3rd of members present and voting. It is used in
1) To pass Rajyasabha resolution to empower the parliament to make laws in the state list.
2) According to articel 368 , Special Majority refers to 2/3rd of the memebrs present and voting + more than 50% of the total house strength. It is used in
1) Removal of CAG and Chief Election Commissioner
2) Removal of judges of Supreme court or High court
3) To declare National Emergency
4) Resolution by the state legislature to create or aboliton of legislative council.
5) Mainly used for the constitutional Amendment Acts
3) The other type of Special majority is according to articel 368 + 50% ratification by the half of the states by simple majority. It is used when constitutional amendment tries effect the fedral structure.
4) According to article 61 , Special majority refers to 2/3rd of the total strength of the house. It is used in impeachment of the president .
